1. Definitions

• “SriLankaExport.com” refers to the website and its services operated by BrandShyp LLC.
• “User” refers to anyone accessing or using our website.
• “Vendor” refers to businesses or individuals listing products on our platform.
• “Buyer” refers to customers purchasing products from listed vendors.

2. Eligibility

To use our services, you must be at least 18 years old and capable of entering into legally binding contracts. By accessing our platform, you confirm that you meet these requirements.

3. Account Registration

• Users must provide accurate information when registering an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• We reserve the right to suspend or terminate accounts that violate these Terms.
• Vendor applications are subject to verification and approval, including review of EDB registration, business registration number, and product compliance documentation.

4. Marketplace Services

We provide a platform for vendors to list and sell products. Transactions are conducted directly between buyers and vendors. We do not own, inspect, or guarantee the quality of any products sold on our platform, though we require vendors to hold valid certifications relevant to their product category (ISO, HACCP, Organic, etc.).

5. Payments & Fees

• Buyers must complete payments through our secure checkout system (Stripe).
• Listings are currently free for verified vendors. Future fees, if introduced, will be disclosed in advance.
• All quoted prices are FOB Colombo unless otherwise stated. See our Landed Cost Calculator for delivered-cost estimates.

6. Shipping & Returns

Vendors are responsible for shipping items in a timely manner per the agreed Incoterm. Buyers should review a vendor’s return policy before purchasing. Disputes regarding shipping, quality, or returns should be resolved between the buyer and vendor in the first instance; we are available to mediate on request.

7. Prohibited Activities

You agree not to:

• List illegal, counterfeit, prohibited, or non-Sri-Lankan-origin products misrepresented as Sri Lankan.
• Use the platform for fraudulent transactions or money laundering.
• Engage in harassment, spam, scraping, or any activities that violate applicable laws.
• Bypass the platform to circumvent our verification processes.

8. Intellectual Property

All content on SriLankaExport.com, including logos, design, text, and original images, is the intellectual property of BrandShyp LLC or used with permission. Vendor product information and images remain the property of the respective vendor and are licensed to SriLankaExport.com for marketplace listing purposes. Users may not copy, modify, or distribute our content without authorisation.

9. Limitation of Liability

We are not liable for any direct, indirect, or incidental damages arising from the use of our platform, including but not limited to losses from vendor non-performance, shipping delays, customs issues, or product defects. Vendors and buyers are responsible for their transactions and any disputes that arise. Our maximum liability is limited to the amount of fees, if any, paid to us in the 12 months preceding the claim.

10. Termination

We reserve the right to terminate or suspend accounts that violate these Terms or engage in fraudulent activities. Vendors may have their listings removed at any time for failing to maintain valid certifications or for repeated buyer complaints.

11. Governing Law

These Terms are governed by the laws of Sri Lanka. Any disputes shall be resolved in the courts of Sri Lanka. Buyers and vendors in other jurisdictions retain rights under their local consumer protection laws to the extent those rights cannot be waived.

12. Changes to Terms

We may update these Terms at any time. Material changes will be announced on the homepage or via email to registered users. Continued use of our services after changes are posted constitutes acceptance of the new Terms.
